I. General provisions

  1. Identification of the store

Unless otherwise specified, the author of the offer and the seller of the products and services offered in store is:

Galeries Lafayette offers products and services for sale to individuals purchasing one or more products for their personal use and not for resale. Galeries Lafayette reserves the right to refuse a sale if it suspects that the purchase does not fall within this scope or is abnormal.

These general terms and conditions of sale are intended to define the rights and obligations of Galeries Lafayette and its customers in relation to in-store sales.

Any purchase made in the store implies full acceptance of these general terms and conditions of sale, which are available at the Le Concierge and Lafayette Services areas of the store and on galerieslafayette.com, under the ‘Our stores’ section.

  1. Prices and payment

The applicable price of products for immediate purchase by the customer is indicated in the store in euros, including all taxes, and confirmed at the checkout. The store is not obliged to apply prices found in other stores or on the Internet.

Payment is made:

  • in full, using the payment methods and currencies accepted and indicated at the cash desk. Payment in foreign currency incurs charges at the customer’s expense. Cash payments are limited to €1,000 for French residents and €10,000 for non-residents. These limits also apply to gift card payments.
  • in full or in instalments using the Galeries Lafayette Mastercard credit card. The terms and conditions of these payment facilities are detailed in store. The GALERIES LAFAYETTE MASTERCARD credit card is optional and linked to a renewable credit facility. It can be applied for in Galeries Lafayette stores and is issued, subject to review and acceptance of the application by the lender BNP Paribas Personal Finance S.A., with capital of €546,601,552. Registered office: 1, Bd Haussmann 75009 Paris – 542 097 902 RCS Paris – ORIAS No.: 07 023 128 (www.orias.fr), trading under the Cofinoga brand. The Galeries Lafayette Mastercard credit card can be used in accordance with the terms and conditions set out in the credit agreement provided at the time of subscription. The choice of payment options constitutes a special use of the renewable credit facility within the limits of the amount available, repayable over the chosen term. The monthly payments for the special use are added to those for any current and subsequent use of the renewable credit facility.
  1. Promotions and rules for combining offers

Unless otherwise stated, promotions and offers cannot be combined and offers are generally not valid for sale items. Some promotions may be reserved for certain customers; the terms and conditions for these offers are available in store.

During promotions reserved for a portion of the customer base, the price charged to customers not included in the promotion is the advertised price.

In the event of cumulative discounts expressly indicated, the first discount must be applied first, followed by the second discount on the remaining balance.

  1. Receipt printing

The receipt issued at the time of purchase is essential in order to benefit from all the services offered by the store (alterations, hands-free shopping, etc.) and to take products from the store.

Receipts, credit card receipts and, where applicable, promotional coupons will be sent in electronic format to the customer at the email address provided for this purpose.

In the event of a special promotional offer or one aimed at a specific customer base, promotional coupons will be printed.

If the customer declines the electronic format, receipts will be printed and provided to the customer.

The email address provided may only be used for commercial prospecting purposes if express consent has been given.

The exercise of the customer’s rights is governed by Article 13 of these Terms and Conditions with regard to the processing of personal data and the privacy policy.

  1. Services offered in store

The store offers various services, including alterations and tax refunds. The terms and conditions of these services are available in store.

Unless otherwise specified, items entrusted to Galeries Lafayette as part of its services must be collected by the customer no later than two months after the date of deposit, failing which Galeries Lafayette shall no longer be responsible for their safekeeping.

Tax exemption is a service available under the conditions defined in store for customers who are eligible in accordance with French and EU law.

  1. Provisions applicable to orders for products unavailable in store

The customer agrees to pay the full or partial price of the product at the time of ordering. Any sums paid in advance are considered deposits. In the event of any outstanding balance, the customer must pay the full amount before delivery.

When placing an order, the customer acknowledges that Galeries Lafayette is unable to immediately confirm the availability of the product ordered. Galeries Lafayette will confirm the availability and estimated delivery date of the product after the order has been placed. The customer may cancel the order up to the date the parcel is dispatched by the store.

For customised products, an estimated delivery time will be provided to the customer when the order is placed.

Customised special orders are final and cannot be cancelled.

The customer agrees to accept delivery of their order and pay the balance.

  1. Ordering products with home delivery

The product will be delivered to the address provided by the customer when placing the order. The customer will receive a call or text message from Galeries Lafayette to arrange a delivery date. Parcels are delivered upon signature.

The transfer of risk occurs upon delivery, at the time the product is handed over. The customer undertakes to be present at their home or to have delegated the delivery of the product to a trusted person.

Customers are strongly advised to check the condition and contents of the package upon delivery. If the package appears damaged or opened, customers are strongly advised to note this on the electronic delivery receipt provided by the delivery driver. If the package appears empty, customers must refuse delivery and contact Galeries Lafayette customer service. Any complaint relating to an apparent defect or damage upon delivery of a product must, in order to be valid vis-à-vis the carrier, be addressed without delay upon receipt of the products, by email or letter addressed to Galeries Lafayette customer service.

In the event of damage, the customer shall describe it in detail on the return slip.

In the event of refusal to accept delivery or return of the product for the reasons mentioned above, the customer is invited to contact customer service.

In the event of order cancellation (product unavailable, order cancellation by the customer before shipment of the product, refusal of delivery by the customer for the reasons set out above), the customer will be entitled to a refund.

  1. Ordering products for collection in store

The product will be delivered to the store where the order was placed only. The customer will receive a call or text message from Galeries Lafayette to arrange a collection date.

The product must be collected within 15 days of receiving the text message informing the customer that the product is available. At the time of collection, the customer must present their order form and the store reserves the right to verify the customer’s identity by requesting original identification.

If a third party arrives at the store in place of the customer with the necessary document for collection, that person is presumed to be authorised to collect the goods. The customer releases the store from any liability relating to the collection of the goods in this case. The customer’s purchases will be handed over to the third party.

The entire order will be checked with the customer and will be considered compliant and complete after signature by the customer.

After this 15-day period has expired, Galeries Lafayette can no longer guarantee the availability of the product and the product will be made available for sale again.

If the order is customised, the customer must pay for it in full. These orders cannot be cancelled.

If the order is not customised, Galeries Lafayette shall retain the deposit as compensation for the immobilization of the product.

In the event of order cancellation (product unavailable, order cancellation by the customer before collection from the store, expiry of the collection period), the customer will be entitled to a refund.

  1. Hands-Free Shopping Service
    1. Definition of the Hands-Free Shopping Service

The Hands-Free Shopping service allows customers to consolidate all their in-store purchases at a single pick-up point, enabling them to continue shopping without being weighed down by bags and purchases. At the end of their visit, customers can collect all their purchases at the pick-up counter located in the basement of the Coupole store by presenting their ID number.

Customers can also choose to have their purchases delivered to them in France or Europe. Depending on the status, delivery may be free or subject to a charge.

This service is free to use and available to all customers with no minimum purchase required.

The Customer must agree to provide certain personal data in order to use the service and receive identification details by email.

  1. Customer journey

When paying for their purchases at the checkout, customers confirm that they wish to use the Hands-Free Shopping service.

The seller shall enter the contact details requested in advance from the Customer.

Either: – the customer is already listed in the customer database, the sales assistant scans the loyalty card and the customer’s details are recognised. – the customer is not listed in the customer database and must provide the details requested by the sales assistant, namely: title, surname, first name, telephone number and/or email address; for deliveries, the full postal address and email address are mandatory.

Purchases are placed in a sealed bag and numbered with a unique identification number to ensure that the customer’s purchases are tamper-proof and traceable.

– In the case of a store pickup: this bag will be delivered later at the pickup counter by the store staff. – In the case of a delivery, the bag will be sent directly for delivery to the address provided by the Customer.

At the end of their shopping trip:

Either the customer goes to the collection counter located in the basement of the store. They present their unique identification code to the store staff in order to identify themselves and collect their purchases after signing in the app.

The identification code provided to the customer is unique, personal and non-reusable. The customer undertakes to keep their code confidential. Each time the customer uses the service, a new code will be provided.

Pick-up times are as follows: 10 a.m. to 7 p.m. Monday to Saturday and 11 a.m. to 7 p.m. on Sundays.

Or the customer chooses to have their purchases delivered and provides the seller with their contact details and delivery address in the app.

The areas eligible for delivery are as follows: – Paris and inner suburbs – Outer suburbs – France outside the Ile-de-France region – European Union

The Hands-Free Shopping service will close for deliveries 1 hour before the service closes in-store.

Any delivery charges will be collected at the cash desk according to the following rates:

  1. Special cases
  • Pick-up at the counter is carried out by a third party other than the customer:

The customer receives a unique identification number for their purchases to enable them to collect them from the counter. The customer may, at their own risk, send a third party to collect their purchases, provided they have given them the unique identification number required for collection. Staff will not hand over any purchases without this identification number.

The individual presenting themselves instead of the customer with the customer’s identification number is presumed to be authorised to collect the order. The customer releases the store from any liability relating to the collection of the products in this case.

The customer’s purchases will be handed over to the third party upon presentation of proof of identity.

  • Purchases not collected within 2 months:

Purchases that are not collected within two months of purchase will be handed over to the lost property service of the City of Paris. In this case, the customer waives all rights of recourse against the store.

  1. Product exchange and refunds

Unless otherwise stated, unused products can be returned to the store in their original packaging up to 30 days after purchase, upon presentation of the receipt or invoice.

After verification and, if necessary, assessment of the product, the product will be refunded using the same payment method used for the purchase.

Please note: – If payment is made in three instalments, the refund will be made by FLOA BANK, which has been appointed by Galeries Lafayette to refund the products. – If payment is made using a gift voucher or gift card (multi-store or single-store), the refund will be made in the form of a Galeries Lafayette gift card.

Products that have been exchanged or refunded must be suitable for resale.

A product may be tried on but not worn. Any product that is incomplete, damaged, used, spoiled, dirty or even partially consumed cannot be exchanged or refunded.

Certain items are not covered by this offer, including but not limited to: – products that have been specially ordered, altered or personalised, – lingerie (without its protective packaging), shoes without their box, bedding removed from its packaging, audio or video recording devices or unsealed software, earrings, etc.

  1. Warranties

The customer acknowledges that they have read and understood the product specifications before making their purchase.

For coloured products, shades may vary from one batch to another, and colour accuracy cannot be guaranteed. These products may also fade. Product dimensions may also vary by + or – 2 cm from the dimensions in the supplier’s catalogue.

All products sold in the store are covered by the legal guarantee of conformity covering defects not resulting from normal use or mishandling by the customer.

“The consumer has a period of two years from the date of delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared. “Where the contract for the sale of goods provides for the supply of digital content or a digital service on a continuous basis for a period exceeding two years, the legal guarantee shall apply to that digital content or digital service throughout the period of supply provided for. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it occurred. “The legal guarantee of conformity requires the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods. “The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience to them. “If the goods are repaired under the legal guarantee of conformity, the consumer shall benefit from an extension of the initial guarantee of six months. “If the consumer requests repair of the goods but the seller insists on a replacement, the legal guarantee of conformity shall be renewed for a period of two years from the date of replacement of the goods. “The consumer may obtain a reduction in the purchase price while retaining the goods or terminate the contract and receive a full refund in exchange for returning the goods if: “1° The trader refuses to repair or replace the goods; “2° The repair or replacement of the goods takes place after a period of thirty days; “3° The repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer bears the costs of returning or collecting the non-compliant goods, or where they bear the costs of installing the repaired or replacement goods; “4° The non-compliance of the goods persists despite the seller’s unsuccessful attempt to bring them into compliance. “The consumer is also entitled to a price reduction or to terminate the contract if the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In this case, the consumer is not required to request repair or replacement of the goods beforehand. “The consumer is not entitled to terminate the sale if the lack of conformity is minor. “Any period during which the goods are out of use for repair or replacement suspends the warranty that remained in force until the goods were returned in good condition. ’The above rights result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code. “Sellers who act in bad faith to prevent the implementation of the legal guarantee of conformity are liable to a civil fine of up to €300,000, which may be increased to 10% of their average annual turnover (Article L. 241-5 of the Consumer Code). “The consumer also benefits from the legal warranty against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are retained or to a full refund upon return of the goods.”

If the product cannot be brought into compliance at the place where it is located, it must be returned to the brand.

The customer may be responsible for sending the goods by post, provided that the costs incurred are not disproportionate.

Commercial warranties: In addition to the legal warranty, certain products may be covered by a commercial warranty offered by their manufacturer, to which Galeries Lafayette is not a party.

The scope and duration of this warranty varies depending on the manufacturer.

The customer can consult the terms and conditions of these warranties on the manufacturer’s website and/or in the product instructions.

To benefit from the commercial warranty, the customer must contact the brands that have granted the commercial warranty.

Galeries Lafayette cannot be held liable in the event that the manufacturer refuses to honour its commercial warranty.

  1. Spare parts

In the absence of specific information about the product, Galeries Lafayette has not been informed of the availability of any spare parts.

Information about the environmental qualities of products may be available in-store. Customers are invited to ask at the store service desk for further details.

  1. Electrical product return policy – 1 for 1

In accordance with the provisions of Article R 541-163 of the French Environmental Code, if a customer purchases: – an electrical or electronic household appliance; – a piece of furniture, an upholstered seat or bedding product, or a textile decoration item,

A used product of the same type and within the quantity sold may be returned free of charge to the store.

Customers should check with Galeries Lafayette sales staff.

Galeries Lafayette may refuse to take back electrical and electronic equipment that, as a result of contamination, poses a risk to the safety and health of its staff. In this case, Galeries Lafayette may offer an alternative solution.

  1. Complaints and mediation service

After customers have taken initial steps in writing with Galeries Lafayette customer service, the mediation service may be contacted for any consumer disputes that have not been resolved.   1. Personal data and telephone marketing

Personal data may be collected when you visit the store and may be used by Galeries Lafayette for statistical purposes to help them better understand their customers and improve the quality of their service.

If the customer has agreed, the personal data collected will also be processed by Galeries Lafayette for the purpose of communicating commercial offers and/or improving and personalising customer relationship management. Only Galeries Lafayette and companies within the Galeries Lafayette Group and/or their partners are recipients of the information provided.

In accordance with the French Data Protection Act, customers have the right to access, rectify or delete their personal data at any time, as provided for by law, which they may exercise as follows:

  • either by modifying their personal information themselves in the ‘My Account’ section accessible on the Website,
  • either by contacting customer service and requesting that their customer data be modified or deleted,

Depending on the choices made when creating or viewing their account, customers may agree to receive commercial offers from Galeries Lafayette and/or their Partners, or to be informed of special offers via email and/or text message.

If the customer no longer wishes to receive these offers, they may request this at any time by clicking on an electronic unsubscribe link available in the emails, by sending a text message to this effect, or by modifying their account settings directly on the website.

  1. Video surveillance

In order to ensure the safety of persons and property, the store is equipped with a video surveillance system with recording (French Law No. 95-73 of 21 January 1995).

  1. Liability

The store and, more broadly, Galeries Lafayette cannot be held liable if the non-performance or poor performance of its obligations is attributable to the customer or to a case of force majeure.

The store and, more broadly, Galeries Lafayette cannot be held liable for any direct or indirect consequences of any malfunction of the customer’s devices/email accounts, beyond their control, which may affect the customer’s ability to collect their purchases, regardless of the cause of such malfunction.

The store and, more broadly, Galeries Lafayette cannot be held liable for any direct or indirect consequences of any malfunctions in the delivery services used to deliver to customers, regardless of the cause of such malfunctions.

  1. Disputes and jurisdiction

These terms and conditions are governed by French law. Only the French version of these terms and conditions of use for the Mes Galeries loyalty programme is legally binding.

Any dispute arising from the interpretation or execution of these terms and conditions and their consequences shall be brought before the competent courts.

Beauty and Care area – Galeries Lafayette Haussmann

Preamble

Wishing to always better meet the expectations of their Clients, Galeries Lafayette provides them, within the Haussmann store, with a wellness area in which they can benefit from treatments, exercise or even eat (hereinafter the “Beauty and care area“).

The purpose of these general terms and conditions of sale (hereinafter the “GTC“) is to define the terms applicable to any Booking and Order of a Service made by a Client on the website of the Beauty and care area accessible from the site: https://www.galerieslafayette.com/m/magasin-haussmann/espace-beaute-et-soins (hereinafter the “Site“).

Consequently, the fact that a Client books a Service or places an Order on the Site implies full and complete acceptance of the GTC in force on the day of the Booking or Order. The Client acknowledges having read the GTC beforehand by checking the dedicated box. They are accessible at any time on the Site and will be sent by e-mail to any Client who has made a Booking or placed an Order.

Galeries Lafayette makes it a point of honor to ensure the accuracy and updating of the information published on the Site, of which it reserves the right to adjust its content at any time and without notice. The adaptations or modifications will then be applicable to any subsequent Order or Booking.

Article 1 – Definitions

Subscription: Contract by which a Client acquires the benefit of one or more Service(s) or a regular service in exchange for a fixed price for a specific duration. Two types of Subscriptions exist; those relating to care services and those relating to the practice of sports.

Galeries Lafayette: Company offering the Booking and Ordering of Services through the Site it operates, as identified above.

Beneficiary: Natural person, of legal age or a minor accompanied by an adult, for whom the Service has been booked.

Gift reference: Reference associated with a Service whose date is not determined, which the Client has purchased to offer to a Beneficiary of their choice.

Client: Natural person over 18 years old, consumer, acquiring one or more Services, for their personal needs or another Beneficiary, through the Site.

Order: Action of a natural person over 18 years old, consumer, acquiring through the Site one or more Services, for their personal needs or intended for another Beneficiary; these Services can be purchased individually, in a pack, in a batch, or be the subject of a Subscription.

Parties: the Client and Galeries Lafayette.

Service Provider: Company providing one or more Service(s) offered on the Site.

Service: Provision of one or more care, wellness, sports or catering services offered for Booking or Order on the Site or associated with a Gift reference and provided by a Service Provider to the Client or Beneficiary.

Booking: Act of ordering a Service on the Site, from a Service Provider, at a specific date and time.

Site: E-commerce site accessible from the address https://www.galerieslafayette.com/m/magasin-haussmann/espace-beaute-et-soins.

The Site is published by GALERIES LAFAYETTE HAUSSMANN – GL HAUSSMANN, a simplified joint-stock company with a sole shareholder, registered with the Paris Trade and Companies Register under number 572 062 594, whose registered office is located at 27, rue de la Chaussée d’Antin, 75009 PARIS (hereinafter “Galeries Lafayette“).

Article 2 – Publisher of the Site

The Site allows Bookings to be made with Service Providers using the Espace Rendez-vous booking tool. The Site also allows Orders to be placed.

Article 3 – Customer Service

Article 4 – Offers and prices of Services

4.1 – Description of Services

The Site allows the Client to make a Booking or purchase one or more Service(s) from Service Providers for their personal use or to offer it to another Beneficiary.

The Service Providers selected by Galeries Lafayette within the Beauty and care area are recognized professionals in their field. It is understood that each of them determines the content and the conduct of the Services they offer. In this sense, it is up to each Service Provider to describe the Services they provide and to specify, where applicable, that they do not accept minors. For Bookings, the Service Provider also determines whether the Service must be paid online or on-site on the day of the Service.

Galeries Lafayette invites the Client to consult the description of each Service, drafted by the Service Provider offering it, and available in the dedicated tab. These indications, without being exhaustive, aim to inform the Client as fully as possible about the essential characteristics of the Services. The Client must pay particular attention to this description, especially in the event of allergies or specific medical or physical conditions (such as a pregnancy, for example). It is recalled for all practical purposes that the Client is solely responsible for the choice they make regarding the Service and its suitability for their needs or those of the Beneficiary. The Client or the Beneficiary is required to transmit the appropriate information to the Service Provider on the day of the Service and, failing this, may under no circumstances hold Galeries Lafayette or the Service Provider liable.

4.2 – Applicable prices

The prices appearing on the Site are indicated in Euros all taxes included and are communicated on the Service sheets. They take into account the VAT and any applicable reductions on the day of the Booking or the Order.

The booked Services are invoiced according to the amount indicated at the time of the Booking or the Order.

Galeries Lafayette pays the utmost attention to the accuracy of the prices of the Services presented on the Site. However, in the event of an obvious error in the price (in particular, a derisory price compared to the real value of the Service), the validated Booking or Order may exceptionally be canceled by Galeries Lafayette.

4.3 – Promotional offers

Price reductions are only valid during the validity period of the offer concerned and only on the indicated Services.

Article 5 – Account creation

5.1 – Registration

The Client is free to browse the Site without being identified. However, to make a Booking or an Order, the Client must first register on the Site by accurately completing the account creation form displayed on the screen, accessible on a secure page. The Client expressly agrees not to use false information or information belonging to a third party.

When creating an account, the Client agrees to provide the information requested from them and guarantees its truthfulness: last name and first name: information necessary to identify the Client; telephone: information necessary for tracking the Booking or the Order; e-mail address: information necessary for sending confirmation and tracking e-mails for the Booking or the Order.

In addition, the Client will mention the information necessary for their identification, i.e., a valid e-mail address and a password of their choice which will be personal and confidential to them. This information will be useful to them later to identify themselves on the Site.

5.2 – Confirmation of account creation

As soon as the account creation form is sent, a customer account (hereinafter the “Account“) summarizing the information transmitted is created by Galeries Lafayette.

To ensure the accuracy of the information, an e-mail is automatically sent to the Client to notify them that their registration has been taken into account. If they do not receive it, the Client is invited to verify the address they entered and/or to check their e-mail inbox (spam, full inbox, etc.).

5.3 – Account Management

The Client can access their Account by entering their e-mail address and password as registered during their registration.

If the Client forgets their password, they can click on “Forgot password?” and thus directly receive by e-mail a link to reset it, after having entered their e-mail address.

Once on their Account, the Client can at any time access the features offered which allow them to consult: Their personal information; Their validated Bookings and Orders; Their history of Bookings and Orders;

The Client can modify their contact details and preferences at any time on their Account or by e-mail addressed to customer service (cf. Article 3 hereof).

Article 6 – Booking and Ordering of Services

6.1 – Client Capacity

Only legally capable natural persons may make a Booking or an Order. During the Booking or the Order, the Client guarantees having the full legal capacity to adhere to these GTC and thus conclude the sale.

In application of Article 1146 of the Civil Code, unemancipated minors are incapable of contracting. Consequently, minors must be represented by the holder of parental authority for the creation of the Account as well as for the Booking or the Order of a Service. Thus, a minor cannot make a Booking or Order alone and must obtain the prior authorization of their legal representative but may, on the other hand, benefit from a Service if the Service Provider accepts it (otherwise, this will be indicated on the offer).

6.2 – Booking Steps

For any Booking, the Client must select the desired Service(s) then select the date and time at which they wish the Service to take place. By default, the Beneficiary is considered to be the Client. If this is not the case, the Client must indicate that their purchase is “to offer” via the proposed option. Galeries Lafayette or the Service Provider cannot be held responsible in the event of an error regarding the Beneficiary or the loss by the Beneficiary of the information linked to the Service. It is expressly agreed that any Booking of a Service is nominative and may under no circumstances be transferred in whole or in part, to a third party, whether free of charge or for a fee. Proof of identity may be requested by the Service Provider on the day of the Service. The Client must then add the Service to their cart.

A summary of the Booking is available in the cart and mentions the nature and price of the Service(s). At this stage, it is still possible for the Client to modify the entered information.

The Client must then certify having read and accepted the GTC to be able to proceed to the next step. They must identify themselves by entering their e-mail address and password, which serves as proof of their identity. If the Client does not have an Account, they must create one.

Before finalizing their Booking, the Client must verify the accuracy of their contact details and the price of the Service. Then, the Client must definitively confirm their Booking by clicking on the dedicated button. This step corresponds to the conclusion of the contract and constitutes proof of the exigibility of the sums due in respect of the purchase of a Service. As soon as they have clicked on this button, the Client explicitly acknowledges their obligation to pay.

6.3 – Order Steps

6.3.1. Order to offer

The Service Providers allow the Client to purchase one or more Service(s) without setting a date for its realization in order to be able to offer it to a Beneficiary of their choice. The Client must then select the Service(s) and then the “To offer” option before adding it to their cart. This gift voucher is valid for a period of 12 months from its date of purchase.

A summary of the Order is available in the cart and mentions the nature and price of the selected Service(s). At this stage, it is still possible for the Client to modify the entered information.

The Client must then certify having read and accepted the GTC to be able to proceed to the next step. They must identify themselves by entering their e-mail address and password, which serves as proof of their identity. If the Client does not have an Account, they must create one.

Before finalizing their Order, the Client must verify the accuracy of their contact details and the price of the Service. Then, the Client must definitively confirm their Order by clicking on the dedicated button. This step corresponds to the conclusion of the contract and constitutes proof of the exigibility of the sums due in respect of the purchase of a Service. 6.3.2. Order of a Subscription

The Client may, on the Site, take out a Subscription for the proposed periodicity: annual, semi-annual, quarterly, monthly.

A summary of the Order is available in the cart and mentions the nature and price of the selected Subscriptions. At this stage, it is still possible for the Client to modify the entered information.

The Client must then certify having read and accepted the GTC to be able to proceed to the next step. They must identify themselves by entering their e-mail address and password, which serves as proof of their identity. If the Client does not have an Account, they must create one.

Before finalizing their Order, the Client must verify the accuracy of their contact details and the price of the chosen Subscription. Then, the Client must definitively confirm their Order by clicking on the dedicated button. This step corresponds to the conclusion of the contract and constitutes proof of the exigibility of the sums due in respect of the Order of a Subscription. As soon as they have clicked on this button, the Client explicitly acknowledges their obligation to pay the Subscription until its term. It will be billed immediately, for the chosen Subscription period.

The subscribed Subscription will be automatically renewed at the end of the selected billing period for an equivalent period, unless the Subscription is terminated before its term under the conditions of article 10 of these GTC.

6.4 – Payment methods

6.4.1.

The online payment methods accepted by the Site are as follows:

  • bank card (Carte bleue, Visa, Mastercard, American Express);
  • Galeries Lafayette Mastercard credit card;
  • Galeries Lafayette gift card;
  • Paypal account.

It is specified that for the Order of a Subscription, the Client must necessarily pay online by bank card according to the terms provided in article 6.4.2.

6.4.2.

All payments must be made in euros according to the following terms: Payment of a Service (individually, in batches or in a pack): depending on the conditions set for the chosen Services, the Client must

  • either pay online by one of the payment methods listed in article 6.4.1 above;
  • Or pay on-site with an accepted payment method in store.
  • Payment of a Subscription: the Client must pay online by bank card. The associated Client’s bank account will be debited for the billing period chosen by the Client, until the Client terminates their Subscription according to the conditions provided in article 10.2.

The Client confirms and guarantees that they are the holder of the payment method used for the payment and that the latter gives access to sufficient funds to cover all the costs necessary for the cash settlement of the Booking or Order.

If the Client must pay online with their bank card, they must provide their bank card number, its expiration date accompanied, where applicable, by the visual cryptogram. In addition, the payment will be validated after entering a 3D Secure code provided by the bank of the Client holding the bank card and communicated by SMS. To this end, the Client guarantees Galeries Lafayette that they have the authorizations that may be necessary to use the chosen payment instrument at the time of the validation of their Booking or Order.

Galeries Lafayette uses a payment service provider and therefore never has access to confidential information relating to the Client’s payment method. The online payment service operator is the company Stripe France, EURL, registered with the Paris Trade and Companies Register under number 807 572 011 and whose registered office is located at 10 Boulevard Haussmann, 75009 Paris (hereinafter “Stripe“).

In the context of Internet payments, an online check is carried out with the competent banking establishments and organizations, queried via the Stripe system which will proceed for this purpose to the storage and automated processing of information relating to each Booking or Order including bank card details, in a secure environment. The transfer of the Client’s personal data to Stripe is governed by standard contractual clauses established by the European Commission. In case of refusal by the bank, the Booking or Order will be automatically canceled and the Client informed by Galeries Lafayette.

If the payment must be made online, the Booking or Order will only be definitively validated after confirmation of the payment. The debit of the card will then be carried out, at the earliest, at the time of the definitive validation of the Booking or Order.

In the event that the Client’s payment cannot be completed, for whatever reason, the Booking or Order would be canceled.

6.5 – Confirmation of the Booking or Order

Once the Booking or Order is validated by the Client, an e-mail acknowledging receipt will be sent to the Client. This e-mail will include all the information and, where applicable, will include the Gift reference. The Booking or the Order will only be considered final after the sending of this e-mail to the Client.

Galeries Lafayette and/or Stripe reserve the right to request proof of identity documents from the Client in order to fight against fraud. In the event of a request for supporting document(s), the Client will be informed by e-mail. If the Client does not provide these documents or if Galeries Lafayette suspects fraud, the Booking or the Order may be canceled.

Furthermore, Galeries Lafayette will be entitled and for legitimate reasons to refuse any Booking or any Order considered suspicious, abnormal or unusual. Galeries Lafayette reserves this right in particular in the event of an existing dispute(s) with the Client, total or partial non-payment of a previous Booking or Order from the Client or one or more cancellations that are too late occurring previously.

Article 7 – Use of the Gift reference following an Order

The Gift reference can be used for one year from the date of the Order. Once in possession of this Gift reference, the client must call the Lobby at 01 42 82 34 24 to book the time slot of their choice.

It is understood that article 8 is applicable as soon as the Beneficiary has booked their Service following an Order.

Article 8 – Modification and cancellation of Services

8.1 – Unavailability of the Service Provider

8.1.1.

In the event of the unavailability of the Service Provider scheduled to perform a Service, revealed after the validation of the Booking, Galeries Lafayette undertakes to inform the Client as soon as possible by telephone or e-mail of the cancellation of the Booking. A solution to book the Service again will be proposed to them. In the event that the proposed solution does not suit them, the Client will have the choice between two possibilities: Refund of the Booking or Order; Modification of the date of the Service.

8.1.2.

In the event of the total and definitive unavailability of the Service Provider scheduled to perform Services as part of a Subscription, Galeries Lafayette undertakes to inform the Client as soon as possible by telephone or by e-mail. The Client will have the choice between two possibilities: Refund of the Subscription, after deduction of the Services consumed on the basis of their preferential unit price; When possible, substitution of the unconsumed Services with equivalent Services offered by another Service Provider.

8.2 – Modification or cancellation by the Beneficiary of a Booking

The Beneficiary may modify or cancel their Booking up to 24 hours before the scheduled time for the Service.

For Bookings made via the Site, the modification or cancellation must necessarily be made online on the Client Account.

For Bookings made directly in store, the modification or cancellation must be made in store.

If the Client has already paid for the Service, they will be fully refunded as soon as possible, by the same means used for the payment.

On the other hand, if the cancellation occurs less than 24 hours before the scheduled time for the Service or if the Beneficiary does not show up, the full amount of the Service will be due by the Client.

Article 9 – Right of withdrawal

9.1 – Withdrawal from an unconsumed Service or Subscription

If the Client or the Beneficiary has not yet benefited from the Service or the Subscription purchased on the Site, the Client has a legal period of fourteen (14) clear days from the confirmation of the Order to notify their decision to withdraw, in accordance with articles L. 221-18 and following of the Consumer Code.

The right of withdrawal may be exercised by the Client by any unambiguous statement expressing their intent to withdraw or by sending Galeries Lafayette the withdrawal form, available on the last page of these GTC, duly completed and signed.

The Order will then be canceled and neither the Client nor the Beneficiary will be able to benefit from the Service.

From the receipt by Galeries Lafayette of the Client’s decision to withdraw, the refund at the invoiced price will take place within fourteen (14) days and will be made using the same payment method as the one used to pay for the Order.

9.2 – Withdrawal from a Subscription

In the event that the Client decides to withdraw from a Subscription in accordance with the provisions of article 9.1, after having consumed one or more Services included in this Subscription, the Client will be refunded the price of the subscribed Subscription, after deduction of the Services consumed on the basis of their out-of-package unit price. In the event that the operation presents a debit balance, the Client undertakes to pay the amounts due upon first request from Galeries Lafayette.

Article 10 – Renewal and termination of a Subscription

10.1 – Automatic renewal

In the event of subscription to a Subscription, this will be automatically renewed at the end of the membership period, for a period equivalent to that initially subscribed, unless it is terminated beforehand under the conditions of article 10.2.

10.2 – Termination

10.2.1. Principle

The Client may terminate their Subscription at the latest 24 hours before the expiration date of the current period. After this period, the Subscription will be automatically renewed for a period equivalent to that initially subscribed by the Client.

To terminate their Subscription, the Client must go to their Account by selecting “View my orders”, then “My subscriptions” and by clicking on “Terminate” for the Subscription concerned. The Client must verify the accuracy of the information relating to their identity appearing on the screen before confirming the termination.

It is specified that the termination of the Subscription will take effect at the end of the current Subscription period. In the event of termination of a Subscription, the Client may not claim any refund, proportional or total, of the price of the unconsumed Services within the framework of this Subscription, except for a Legitimate reason.

Article 11 – Liability

The Services offered by the Service Providers comply with the French legislation in force.

Except in cases expressly provided for by the texts in force, the liability of Galeries Lafayette is limited to direct and foreseeable damages that may result from the use of the Site by the Client. For the Services offered on the Site, only the Service Provider is responsible for damages that may be caused by its services.

Galeries Lafayette and the Service Providers also disclaim all liability in the event that the non-performance or improper performance of the obligations contained in the GTC is due to the Client, in particular due to an error when entering the requested information. The Client will then not be able to claim any compensation whatsoever.

Likewise, neither the liability of Galeries Lafayette nor that of the Service Providers shall be engaged if the non-performance or improper performance of the Services is attributable to the unforeseeable and insurmountable act of a third party foreign to the provision of the Services provided for in these GTC, or to a case of unforeseeable, irresistible and external force majeure.

Galeries Lafayette is not responsible for the content and functioning of the sites available by link on the Site, as well as for damages of all kinds that may be suffered by the Client during a visit to these sites. The use of the Site implies the Client’s knowledge and acceptance of the characteristics and limits of the Internet and the technologies linked to it, the lack of protection of certain data against possible misappropriation or hacking and risks of contamination by possible viruses circulating on the network. Galeries Lafayette declines all liability in the event of misuse or an incident linked to the use of the computer, Internet access, maintenance or malfunction of servers, the telephone line or any other technical connection, and the sending of forms to an incorrect or incomplete address, any computer errors or defects noted on the Site.

Article 12 – Personal data

Galeries Lafayette attaches great importance to the protection of personal data.

In accordance with the applicable regulations and in particular Regulation (EU) 2016/679 relating to data protection (known as the “GDPR“), Galeries Lafayette has created an electronic file that lists certain personal data relating to its Clients in order to be able to manage their Booking or Order, ensure the monitoring of the customer relationship and send them information and solicitations of a commercial nature. Some of the transmitted and/or collected information also makes it possible to better know the Client and thus to improve and personalize the services offered by Galeries Lafayette.

The Client has at any time an individual right of access, deletion and rectification of their personal data provided for by the law which they can exercise as follows: either by modifying their personal information in the “My Account” area accessible on the Site, either by contacting customer service stating a request for modification or deletion of their customer data, or by making the request by e-mail to the address [email protected].

In the context of the Service, if the Service Provider collects personal data, the Service Provider acts as an independent data controller of the collected data. With the exception of the Booking data and the data relating to the subscription of a Subscription, the personal data collected by the Service Provider are not transferred to Galeries Lafayette. Galeries Lafayette cannot be held liable due to a collection or processing carried out by the Service Providers. If the Client wishes to exercise their rights over the personal data collected by the Service Provider, they must directly contact them.

When Galeries Lafayette collects personal data necessary for processing the Booking or the Order, these data will be collected:

  • for the purposes of the Service, visible by the Service Provider concerned; and
  • to make a payment on the Site, collected and processed by Stripe. Stripe will then be the data controller of said data. To learn more about Stripe’s privacy policy: https://stripe.com/fr/privacy.

Depending on the choices made when creating or subsequently consulting their Account, the Client may agree to receive commercial offers and/or be informed of specific operations from Galeries Lafayette and/or its partners through all channels (SMS and/or e-mail and/or social networks in particular). If the Client no longer wishes to receive these offers, they can request this at any time by proceeding as follows:

  • For e-mails: by clicking on an electronic unsubscribe link available in the e-mails concerned;
  • For SMS: by sending “stop sms” in response to the commercial message received by SMS; or
  • By modifying their Account settings directly on the Site.

Certain personal data are also collected by the technical service providers of Galeries Lafayette, in particular for the management of Orders and Bookings.

Article 13 – Intellectual property

All the elements published within the Site, such as sounds, images, photographs, videos, writings, animations, programs, graphic charter, databases, software, and other underlying technologies are protected by the provisions of the Intellectual Property Code and belong to Galeries Lafayette or, where applicable, have been duly granted to them. The trademark “Galeries Lafayette”, all the figurative or non-figurative trademarks and more generally all the other trademarks, illustrations, images and logotypes appearing on the articles, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of Galeries Lafayette, with the exception of the rights held by the Service Providers and the partners of Galeries Lafayette over the visuals of their services, over their trademarks and logos presented on the Site.

Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logotypes, for whatever reason and on whatever medium, without the express prior agreement of Galeries Lafayette, is strictly prohibited. The same applies to any combination or conjunction with any other trademark, symbol, logotype and more generally any distinctive sign intended to form a composite logo, with the exception of the logos and descriptive signs belonging to the brands present on the Site. The same goes for all copyrights, designs and models, patents which are the property of Galeries Lafayette.

Galeries Lafayette prohibits any affixing of a deep hypertext link to the Site or of a hypertext link that would use a transclusion technique. A user wishing to place a simple link on their personal website leading directly to the homepage of the Site, must imperatively request prior express authorization from Galeries Lafayette.

Article 14 – Force majeure

The performance by Galeries Lafayette and/or the Service Providers of all or part of their obligations will be suspended in the event of the occurrence of a fortuitous event or force majeure, as defined in article 1218 of the Civil Code, which would hinder or delay its performance. Are considered as such, in particular, without this list being limitative, war, riots, insurrection, social unrest, strikes of all kinds.

Galeries Lafayette or, where applicable, the Service Provider will inform the Client of a similar fortuitous event or force majeure within seven days following its occurrence.

In the event that this suspension continues beyond a period of fifteen (15) days, the Client will have the possibility to cancel the current Booking, and their refund will then be processed.

Article 15 – Partial invalidity

If one or more stipulations hereof were judged to be illegal or null, this nullity would not have the effect of resulting in the nullity of the other provisions of the GTC.

Article 16 – Agreement on proof

It is expressly agreed that the Parties may communicate with each other electronically or by telephone via the Site’s customer service, for the purposes of these GTC.

Technical security measures are provided to ensure the confidentiality of the exchanged data.

The Parties agree that the e-mails exchanged between them validly prove the content of their exchanges and, where applicable, of their commitments, in particular with regard to the transmission and acceptance of Bookings and Orders.

Article 17 – Conservation and archiving

The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1379 of the Civil Code.

Article 18 – Complaints and mediation

Galeries Lafayette is a member of FEVAD (Federation of e-commerce and distance selling). As such, Galeries Lafayette undertakes to honor the rules of respect for the Client contained in the professional code of the Quality Charter www.fevad.com.

If the Client wishes to make a complaint, they can contact customer service (cf. article 3).

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, after a prior written step by the Client to Galeries Lafayette customer service, the Mediator Service may be seized for any consumer dispute whose settlement has not succeeded. For this, Galeries Lafayette adheres to the e-commerce Mediator service of FEVAD whose contact details are as follows: 60 Rue La Boétie – 75008 Paris. Article 19 – Applicable texts and competent jurisdiction

These GTC are subject to the application of French law.

Only the French version of these GTC is authentic.

Any dispute likely to result from the interpretation or execution of these GTC and its consequences will be brought before the competent courts of Paris.
